Number One Priority

Your mortgage should be your number one priority to pay, before any other debts. Try to protect your mortgage - your home - as well as you can. If you find yourself short this month, you may have to skip some payments, but don't skip the mortgage if at all possible. If you loose your home, you will find yourself in a whole lot more hurt than if you miss a couple payments on credit cards for example. If you can't make the mortgage payments, get in touch with your lender immediately, and see if you can work something out. Most companies are more than willing to work with you. It is in their best interest to do so as a foreclosure ends up costing them a lot of money too.

There are some who would propose that the restrictions imposed on chapter 7 bankruptcy laws by new guidelines actually are a good long-term solution to the debt issue.  Many claim that there are those who file under chapter 7 bankruptcy laws in an unwarranted manner.  It’s felt that perhaps people are taking an easy way out and deliberately avoiding creditors.  Supporters of the new regulations claim that the move away from Chapter 7 toward Chapter 13 encourages more personal responsibility in seeking to properly manage finances.

There are additional filing requirements under the new chapter 7 bankruptcy laws.  These include fewer automatic protections, such as the stopping or delay of evictions, child support, etc.  Mandatory credit counseling is also asked of filers under Chapter 7 bankruptcy laws.  Once the course is complete, they must also undertake a financial management course, as well.  More filings have been hit by increases in attorney fees under the new act.
